Any person who keeps premises open for public refreshment resort and entertainment between the hours of 10pm and 5am is required to hold a Late Night Refreshment House Licence.


The essential requirement is that people must resort to premises and so take-aways are not covered by the legislation.

There are no powers for the Council to refuse a licence but a time restriction can be imposed to ensure that residents are not unreasonably disturbed by noise. Any time restriction cannot be earlier than 11pm.

All Late Night Refreshment House Licences expire on enter date in each year and they are not transferable to another person. This means that if the person running the premises changes, a new licence has to be applied for.

Prior to a licence being granted, the Police, the Planning Department and the local Environmental Health Officer are consulted.
